Terms and Conditions for Mandarin Oriental Jumeira, Dubai Online Cake Shop

 

 

1.      Contract with MODUB

1.1.  Mandarin Oriental Jumeira, Dubai (“MODUB”) is a limited liability company organized under the laws of the United Arab Emirates (“UAE”).

 

1.2.  These terms and conditions (“Terms”) govern your order of goods and services (“Goods”) from MODUB. By placing an order, you agree to these Terms.

 

1.3.  These Terms constitute the entire agreement between MODUB and you. MODUB is not bound by any statements or representations not expressly included in this document.

 

2.      Placing an Order

2.1.  Orders must be placed via the official MODUB website. By placing an order, you make an offer to purchase Goods in accordance with these Terms.

 

2.2.  Orders are processed daily from Monday to Sunday, with confirmation sent within 6 hours. Orders placed after 6 PM will be processed the next business day.

 

2.3.  MODUB reserves the right to cancel or modify any order at its sole discretion due to operational constraints, availability, or other unforeseen circumstances. In such cases, you will receive a full refund for payments made.

 

3.      Delivery and Pickup

Delivery times and pickup notifications will be communicated to customers via email or phone as part of the order confirmation process. This ensures clarity and avoids any miscommunication regarding the timing and logistics of orders.

 

3.1.  Delivery Service

  • Delivery areas include Jumeira 1 & 2, DIFC, City Walk, and Business Bay.
  • Delivery hours: Monday to Sunday, 10:00 AM – 10:00 PM. 
  • Delivery fee: AED 90 per order.
  • All orders require a 6-hours pre-order notice. Orders placed after the 6 PM cut-off will be delivered the next business day.

 

3.2.  Pickup Service

  • Pickup is available at The Mandarin Cake Shop located on the ground floor of MODUB.
  • Pickup hours: Monday to Sunday, 10:00 AM – 10:00 PM.
  • Orders will be ready for collection within 6 hours. Customers will be notified via email or phone.

 

3.3.  Once Goods are delivered or collected, MODUB is not liable for any loss, damage, or deterioration of the Goods.

 

4.      Returns, Cancellations, and Refunds

4.1.  Changes to delivery or pickup dates require a minimum of 48 hours’ notice. Requests made after this period are subject to MODUB’s discretion.

 

4.2.  Cancellations must be made by contacting MODUB at +971 4 777 2223. Cancellations within 72 hours of the scheduled pickup or delivery date are non-refundable.

 

 

5.      Pricing and Payment

5.1.  Prices for Goods are displayed on the MODUB website and may change without prior notice. However, confirmed orders will not be affected by price changes.

 

5.2.  Payment is required at the time of order placement using a valid debit or credit card.

 

 

6.      Liability and Disclaimer

6.1.  MODUB disclaims liability for any loss or damage arising from misuse, mishandling, or improper storage of Goods after delivery or pickup. This disclaimer has been reviewed to ensure compliance with UAE consumer protection laws.

 

6.2.  MODUB is not liable for any allergic reactions or food-related illnesses, including food poisoning. Goods are prepared in facilities where allergens may be present. Customers with allergies must exercise caution.

 

6.3.  Customers agree to release MODUB from any liability related to food poisoning, allergic reactions, or health issues caused by consuming the Goods. This clause does not exclude liability that cannot be legally waived under UAE law, as confirmed by legal review for compliance with applicable UAE regulations.

 

6.4.  MODUB is not liable for any allergic reactions or food-related illnesses, including food poisoning. Goods are prepared in facilities where allergens may be present. Customers with allergies must exercise caution.

 

7.      Force Majeure

7.1.  MODUB is not responsible for delays or non-performance resulting from events beyond its control, including natural disasters, strikes, or government actions.

 

8.      Data Privacy

8.1.  Personal information is handled in accordance with MODUB’s Privacy Policy.

 

9.      Governing Law and Jurisdiction

9.1.  These Terms are governed by UAE law. Any disputes will be resolved exclusively in UAE courts.

 

By placing an order, you acknowledge and accept these Terms. These terms will be prominently displayed on the MODUB website during the checkout process to ensure maximum visibility and acknowledgment by customers.
